This section collects information where your transaction involves a change in beneficial ownership without a change in legal title. Duty applies, at the same rates as that for a transfer of full legal title to land, on transactions that:
- Transfer an equitable estate or interest in land.
- Result in a change in the beneficial ownership of land (other than a transaction involving units in a unit trust scheme).
In this context, the expression 'beneficial ownership' has a wide meaning, including but not limited to ownership of dutiable property by a person as trustee of a trust. It also includes the interest a person may have in a fixed trust, joint venture or trust partnership structure owning land in Victoria.
